KARLSRUHE (dpa-AFX) - The Federal Court of Justice (BGH) is about to issue another ruling on the question in which cases businesses that had to close in the Corona lockdown will get money from their insurance company. The decision is expected to be announced at 2 p.m., the top civil judges in Karlsruhe announced at the conclusion of Wednesday's hearing.

Whether the insurance company has to pay depends on the agreed insurance conditions. For a variant that was used in very many contracts, there is already a BGH ruling from January 2022. Here, the diseases that can lead to an officially ordered closure were listed individually - and Covid-19 was not among them. Those affected will therefore not receive any money.

In the variant that is now at issue, the insurance conditions referred to the diseases listed in the Infection Protection Act. Covid-19 was included there as of May 23, 2020. The Celle Higher Regional Court had therefore ruled that the plaintiff hotel operator was not entitled to money from the insurance company for a closure from March 2020, but for a second closure from November 2020. After initial deliberations, the BGH judges see it the same way, as Chairman Christoph Karczewski said.

According to the German Insurance Association, this form of clause is rather rare. In how many contracts it appears, can not be quantified. In the concrete case it concerns a hotel in Hameln, which was insured with the Ergo./sem/DP/jha
