Federal Court Grants to Pecém I an Advanced Injunction to Suspend Unavailability Charges
São Paulo, January 24th, 2014 - EDP - Energias do Brasil S.A. ("EDP" or "Company") (BM&FBovespa: ENBR3) announces today to its shareholders and the market in general, that the 15th Federal Court of the Federal District granted an Advanced Injunction to the Company's subsidiary Porto do Pecém Geração de Energia S.A. ("Pecém I") suspending the unavailability cost on an hourly basis, with immediate effect, and determines that the calculations have to be based on a 60 month average. Charges are paid with a two month delay and the next payment due would refer to December, 2013.
On January 07th, 2014, Pecém I filed a lawsuit against Aneel, Brazilian Electricity Regulatory Agency, questioning the penalties being charged on an hourly basis from the differences between the net declared power generation capacity and the actual generation of the plant (unavailability charges). The Contracts for Electricity Trading in the Regulated Environment (CCEAR) consider a measure based on a moving average of 60 months of the effective availability and do not provide penalties based on an hourly calculation.
