Management Board of the RAFAMET S.A. Machine Tool Factory in Kuźnia Raciborska informs that today, in the performance of the leasing agreement concluded on August 28, 2020 between Koleje Wielkopolskie Sp. z o.o. and a subsidiary of the Issuer RAFAMET SERVICE & TRADE Sp. z o.o., about which the Issuer informed in the current report No. 31/2020, an agreement was concluded between the Issuer (Contractor) and the subsidiary RAFAMET SERVICE & TRADE Sp. z o.o. (Purchaser).

The subject of the contract is the sale by RAFAMET S.A. to a subsidiary of a computer-controlled Underfloor Wheel Lathe with software in Polish, intended for the machining of the outer contour of wheelset wheels and brake discs in railway rail vehicles.

The total remuneration of the Contractor is PLN 4,850,000.00 net. The contractor undertakes to complete the full scope of the subject of the contract by August 13, 2021.

The contracting authority is obliged to pay remuneration for the subject of the contract in 84 monthly installments.

In the event of non-performance or improper performance of the contract, the Contractor undertakes to pay the Ordering Party contractual penalties:

1. in the amount of 10% of the gross value of the remuneration, if the Ordering Party or the Contractor withdraws / terminates the contract due to circumstances for which the Contractor is responsible,
2. in the amount of PLN 2,500.00 for failure to perform any of the obligations set out below:
3. • implementation of the full scope of the subject of the contract by the Contractor,
   • removal by the Contractor of the fault / defect during the warranty period, on the dates specified in the agreement, for each commenced day of delay,
4. in the amount of PLN 1,000.00, each time the Ordering Party finds that the Contractor has failed or improperly fulfilled any obligation referred to in the "Contractor's Obligations" section of the contract.
