U.S. Patent and Trademark Office Confirms EasyLink Services International Corporation Patent Claims Asserted Against j2 Global Communications

NORCROSS, Ga., Sept. 27, 2011 (GLOBE NEWSWIRE) -- EasyLink Services International Corporation ("EasyLink" or "Company") (Nasdaq:ESIC) (www.easylink.com), a global provider of comprehensive messaging services and e-commerce solutions, announced today that the U.S. Patent and Trademark Office ("PTO") confirmed the patentability of all the claims in EasyLink's U.S. Patent No. 7,804,823 ("the '823 Patent"), which the Company's wholly-owned subsidiary, Xpedite Systems, LLC, has asserted in a patent infringement lawsuit against j2 Global Communications, Inc. (Nasdaq:JCOM).

The suit, filed in the U.S. District Court for the Northern District of Georgia, alleges that j2 Global infringes the '823 Patent, entitled "Systems and Methods for Communicating Documents Via an Autonomous Multi-Function Peripheral Device." EasyLink, through its subsidiary, Xpedite, is seeking monetary damages for past infringement, injunctive relief prohibiting j2 Global from continuing to infringe the patents, and other remedies. 

After the suit was filed, j2 Global filed a petition with the PTO seeking to initiate an inter partes reexamination proceeding, wherein j2 Global argued that the PTO should find all of the '823 Patent claims unpatentable. In response, the PTO opened a reexamination proceeding, but immediately issued an Action Closing Prosecution, which rejected all of j2 Global's arguments and confirmed the validity of every claim of the '823 Patent.
