CVS agreed to pay $36.5 million to resolve allegations that it fraudulently overbilled Medicaid for insulin prescriptions during a 10-year period.

The pharmacy retail giant reached an agreement to settle the claims brought by 36 attorneys general and the Justice Department, New York Attorney General Letitia James said Tuesday.

As part of the settlement, $25.1 million will be paid to Medicaid programs in participating states. New York will receive $2.3 million as part of the agreement

"From 2010 to 2020, CVS knowingly dispensed more insulin to customers than they needed while maintaining that they were reporting the correct amount of insulin in their prescriptions," James said.

CVS said it was pleased to have resolved the matter and noted that labeling changes, insulin dosing variability, and varying payor supply limits made "billing for these medications incredibly complex." Agreement on a settlement was first announced in December, the company said.
